Acceptance of Terms

By accessing our website, making a reservation, or visiting Lo D'Alex Restaurant & Bar, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable Florida and federal laws and regulations. These Terms constitute a legally binding agreement between you and Lo D'Alex.

Lo D'Alex reserves the right to modify these Terms at any time. Changes become effective upon posting to this page. Continued use of our website or services following any modification constitutes acceptance of the updated Terms.

Reservation Policy

• Reservations must be cancelled at least 24 hours in advance to avoid charges
• A no-show fee of $10.00 per person will be charged to the card on file for guests who do not cancel within the required window or fail to appear
• For groups of 8 or more guests, please contact us directly at (305) 987-1544 — a signed group agreement and deposit may be required
• Lo D'Alex reserves the right to release reserved tables after a 15-minute grace period following the reservation time without a courtesy call
• Reservations are non-transferable and may not be sold or resold

Nightlife Experience & Cover Charge

• Dining Experience (12:00 PM – 11:59 PM): Full gastronomic menu, signature cocktails, and ambient entertainment. No cover charge.
• Nightlife Experience (12:00 AM – 4:00 AM): Live shows, DJ, bottle service, and late-night bites. Cover charge of $125.00 – $150.00 per person, subject to change based on the featured entertainment. The applicable rate will be communicated by our team upon request and published on our social media channels prior to the event.
• Dinner reservation holders are guaranteed their table until 11:59 PM. Should guests wish to continue into the nightlife experience, the cover charge will apply.
• The nightlife experience requires guests to be 21 years of age or older. Valid government-issued photo identification is mandatory.
• During the nightlife experience, the kitchen is closed. Only cocktails, beverages, and selected late-night bites are available.
• Lo D'Alex is not responsible for changes to the entertainment lineup. In the event of artist cancellations or changes, no refund of the cover charge will be issued, though Lo D'Alex will make reasonable efforts to provide alternative entertainment of equal or greater value.

Consent (Opt-In)

Consent to receive SMS messages is obtained clearly and explicitly through web forms, checkboxes, or other authorized means. Granting your consent to receive SMS messages is not a condition for making a reservation or purchase at Lo D'Alex Restaurant & Bar.

Service Cancellation (Opt-Out)

You may cancel SMS messages at any time by replying STOP to the number from which you receive the messages. Once your request is sent, you will receive a cancellation confirmation and will no longer receive messages. To re-subscribe, you must complete the registration and consent process again.

Special Services & Celebrations

• Birthday & Celebration Service: Guests wishing to arrange a birthday or special occasion celebration in-house must notify our team at the time of booking. This service carries an additional fee of $100.00 and includes table decoration, a dedicated server, and celebratory presentation. Walk-in birthday requests on the night of the event cannot be guaranteed.
• Bottle Service: Available during the nightlife experience. Pricing and availability are subject to change. Advance reservation strongly recommended.
• Private & Corporate Events: Private dining and corporate event inquiries are subject to a separate Event Agreement with specific deposit, cancellation, and payment terms. Please visit our Events & Private Dining page for details.

Dress Code

Lo D'Alex maintains a smart casual to formal dress code at all times to ensure an elevated experience for all guests. Our team reserves the right to deny entry to any guest whose attire does not meet our standards.

• Not permitted: Shorts, tank tops, sleeveless shirts, athletic wear, flip-flops, beach sandals, sports jerseys, or ripped/distressed clothing
• Recommended attire: Smart casual or formal — dress shirts, blouses, slacks, chinos, blazers, cocktail dresses, or formal footwear
• The dress code applies to all guests regardless of reservation status, party size, or prior visits
• Denial of entry due to dress code does not entitle any guest to a refund of advance payments, deposits, or fees

Food Allergens & Dietary Restrictions

Lo D'Alex takes allergen awareness seriously. However, our kitchen handles common allergens including tree nuts, peanuts, shellfish, fish, dairy, eggs, gluten, and soy. We cannot guarantee the complete absence of cross-contamination.

Intellectual Property

All content on the Lo D'Alex website — including but not limited to text, photography, video, graphics, logos, menu designs, and brand elements — is the exclusive property of Lo D'Alex or its licensors and is protected under applicable United States and Florida copyright, trademark, and trade dress laws.

• You may not reproduce, distribute, modify, publicly display, or create derivative works of our content without prior written consent
• The Lo D'Alex name, logo, and distinctive brand elements are trademarks of Lo D'Alex. Unauthorized use is strictly prohibited.
• Guest-submitted photographs of food or the venue may be shared on social media provided Lo D'Alex is tagged. By tagging us, you grant Lo D'Alex a non-exclusive, royalty-free license to reshare your content with attribution.

Limitation of Liability & Disclaimer

To the fullest extent permitted by Florida law, Lo D'Alex, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our website or services
• Changes, cancellations, or modifications to entertainment programming
• Loss, theft, or damage to personal property on our premises
• Allergic reactions where allergen information was disclosed prior to service
• Third-party service failures including OpenTable, payment processors, or delivery partners

Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

In no event shall Lo D'Alex's total aggregate liability to you exceed the amount actually paid by you for the specific service giving rise to the claim.

Governing Law & Dispute Resolution

These Terms of Service and Privacy Policy are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. The Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. §§ 501.201–501.213) applies to consumer-related disputes.

Any dispute, claim, or controversy arising from or relating to these Terms or your visit to Lo D'Alex shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue.

Before initiating formal legal proceedings, we encourage you to contact us directly at info@lodalex.com to resolve any concern. We are committed to addressing complaints promptly and in good faith.

Age-Gated Content

Some services, promotions, communications, or content offered by Lo D'Alex Restaurant & Bar may be subject to age restrictions, in accordance with Carrier policies, CTIA Guidelines, and applicable legislation.

By registering, subscribing, or interacting with our services, the user represents and warrants that:

• They are at least eighteen (18) years of age, or the minimum legal age required in their jurisdiction to receive such content.
• They provide truthful and accurate information regarding their age.

Lo D'Alex reserves the right to:

• Implement age verification mechanisms when required.
• Restrict, suspend, or cancel access to content or services if it is determined that the user does not meet applicable age requirements.
• Refuse to send SMS/MMS messages when the content is classified as age-gated and the user has not confirmed meeting the minimum required age.

The user acknowledges that certain content or messages may not be available to minors and that failure to comply with this requirement constitutes a violation of these Terms and Conditions.
